Your account

You need an EyeCues account to use EyeCues, with your real name and an email address you control. You must be at least 18. You are responsible for what happens on your account, so only approve phones and browsers that are yours, and tell us right away if you think someone else has gotten in.

Recording other people

EyeCues transcribes what the people around you say. Laws about recording conversations differ by place, and some require everyone in a conversation to agree. You are responsible for following the laws where you use EyeCues, including telling people and getting their consent when the law requires it. Do not use EyeCues where recording is not allowed, or to capture conversations you are not part of.

Answers can be wrong

Answers, summaries, transcripts and suggestions are produced automatically and can be incomplete or wrong. Check anything important before you rely on it. EyeCues is not a substitute for professional advice, and nothing it shows is medical, legal, financial or safety advice.

Safety

Do not let EyeCues distract you when you need your attention elsewhere, such as while driving, operating machinery, or crossing a street. Text on your lens is never more important than what is in front of you.

Plans and billing

• Free includes 5 hours of listening a month. Standard is $14.99 a month, or $149.99 a year, for 60 hours a month. Pro is $29.99 a month, or $299.99 a year, for 150 hours a month. Only time someone is talking counts toward your hours.
• Hours reset each month and do not roll over. When you run out, EyeCues stops listening until the next month or until you change plans.
• Paid plans renew automatically every month, or every year if you pay yearly, charged to your card through Stripe, until you cancel. Prices are in US dollars, and you are responsible for any taxes that apply.
• Cancel or change plans any time under Plan and usage, in EyeCues or at myeyecues.com. If you cancel, your plan stays active until the end of the month or year you paid for, then moves to Free.
• Payments are not refunded for partial months or years, except where the law requires it.
• We may change prices or plan hours. We will tell you at least 30 days before a change affects what you pay, and you can cancel before it does.

Your content

Your conversations, documents, lists and everything else you put into EyeCues stay yours. You give us permission to store, process and send that content only as needed to run EyeCues for you, as described in the Privacy Policy. Only add documents you have the right to use.

Acceptable use

Do not use EyeCues to break the law, to harass, stalk or spy on anyone, to collect other people's personal information without their knowledge, or to cheat on exams or in other settings that forbid outside help. Do not try to break into EyeCues, get around plan limits, copy or resell the service, or overload it. We may suspend or close accounts that do.

Even Realities

EyeCues is an independent app made by Hibb Co. LLC. It is not made by or affiliated with Even Realities. Your glasses, the Even app and the Even Hub are covered by Even Realities' own terms. We are not responsible for them.

Changes to EyeCues and these terms

We keep improving EyeCues, so features may change, and some may be added or removed. If we change these terms in a way that matters, we will tell you by email or in EyeCues before the change takes effect. If you keep using EyeCues after that, the new terms apply.

Ending your account

You can stop using EyeCues and cancel your plan at any time, and you can ask us to delete your account as the Privacy Policy describes. We may suspend or close your account if you break these terms, or if we stop offering EyeCues. If we stop offering EyeCues, we will give you notice and a chance to download your data.

No warranty

EyeCues is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that EyeCues will be uninterrupted, error free, or fit for a particular purpose.

Limits on liability

To the fullest extent the law allows, Hibb Co. LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of EyeCues. Our total liability for any claim about EyeCues is limited to the amount you paid us in the 12 months before the claim, or $50 if that is more. Some places do not allow these limits, so they may not all apply to you.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Michigan, unless the law where you live gives you the right to bring it there.
